250gb Phat HDD to 4gb Slim = Xbox live ban?

I have an old 250gb phat black xbox 360 that was fried in a electrical surge. When the surge happened my 250gb hard drive was not connected. I now need a new xbox and im wondering if i buy a 4gb slim can I open the casing on my 250gb HDD and pull the HDD out and put it into the casing of the 4gb slim or will this cause an xbox live ban?

1. Buy a Hard Drive Replacement Case Shell for the Slim.
2. Take the 250 GB out of the Phat HD case shell.
3. Put it in the Replacement Case Shell for the Slim.
4. Done.

the hard drive is the same, just as stated it would not be in the right casing, you can however put it in the machine without the case, just slide it to the back until it clicks in, you wouldnt want to move it around a lot because it could fall out very easy, as far as a ban, it could not happen its the same hdd
