Yup. Flashcards don't change anything on the DS(i)/3DS. Well, they leave a trace on the 3DS, just like any other game. However, considering they spoof a real game, Nintendo will never know whether you've used a flashcard or the game that the flashcard spoofed.

Get a flashcard (DSTwo, acekard 2i, r4i gold), download the official latest firmware, out the firmware and some games in the sd card, put the flashcard and sd card in the DSi/3DS, power on and play games.

take out the flashcard, back to a new 3DS again.

the real 3DS flashcard which can play 3SD games won't come out in short time. that's for sure.
