I think the guy you're talking about had a business modding xboxes and what-not. I believe the article was featured here. If you've got some neighbors or cross-friends that wanna report you, MAYBE. If you've called Microsoft and turned yourself in, the odds are against you. Otherwise, you're probably safe. I know an American in Japan that was caught but he received punishment via the military because the courts turned it over.

Here ya go, the article I'm referring to:

A snippet:A man in the UK has been convicted of chipping and selling Xbox consoles through his website. The 22 year old is the first man in the UK to be convicted for modifying games consoles. He also fitted the new consoles with a 200GB HDD containing 80 games. He was sentenced to 140 hours community service in Caerphilly Magistrates Court in Wales.

Modding your xbox is like modding your pc...there's nothing "illegal" about it. However, the problem comes when illegal material starts being distributed (say for instance, a dashboard like Evox). This dashboard uses MS Dashboard code, and it is not unauthorized to do so. No one makes a big deal about this unless someone is making a service of doing this (for one, you cannot make a business or service distributing illegal material, and for two, he didn't have a license to do so). So you see, it was not just having a modded xbox that got him into trouble.
