Italy accidentally legalizes some P2P music

It seems that Italian parliament has inadvertently legalized some music sharing over P2P networks.
The new copyright law, which was passed by both houses of the parliament allows Italians to share all the music they want over the internet as long as it is "noncommercial" and the music is "degraded" in terms of quality.

everything should be free for educational purposes, how the hell does a civilisation advance anyway(rhetorical question), by building on ideas and works that already exist obviously, but big media wants a piece of every pie just like the mafia protection racket.
big media really makes me sick to the gut with how the thwart society from advancement and i will never again purchase any new media, its all 2nd hand movies/games/music for me from now, hit these companies where it hurts.

But if this is only limited to "non-commercial music", I guess that rules out everything released by a label or on CD´s.

So, hypothetically speaking, if I was having a debate with somebody whether The Beatles produced better music than Elvis, would sharing the music of either artist classify as “educational or scientific” for the purpose of a “debate?”
