take the mod off before you send it in. If it's firmware I think it can be reversed.

hell, i left the FW on mine when i sent it in. its wasnt like they were going to check and see if it played burnt games. i just made sure when i flashed it the first time that i didnt screw up the seal, and all was good.

While it's not illegal to flash your drive, it's bad advice to tell people to send there's in that still have a modded firmware.
It's not hard to flash the 360 back to original firmware. If you had someone else do it for you, have them flash it back for you. And if they are a good modder, they SHOULD give you the warranty sticker in perfect condition back to you after modding. So there should be no worries there. Unless you dealt with a crooked modder that likes to keep them, or did it yourself and ripped the sticker off.
Don't forget..they have your info....things could (but I doubt it) come back to you later.

not in every country its not.
to CL: i just didnt want to waste the time flashing it back to original FW before i sent it in. it wasnt worth my time to take it apart and do it, i had more important things to do at the time.

Hey, I wasn't directing that at you really...just in general.
How is flashing a drive illegal anyway? You own the product. It's your to do what you want.

That may be... their FW, they can keep it. But when I buy something with my money...I own it. I can do what I want with it.
I will respect copyright laws (media), but a device that I bought...I own.
I can see how this can get ugly, so i will leave it at that.

they throw in a huge trash compacter, smash it all up, send it back and say 'nice try, you almost got away with it, have fun fixing it now you stupid consumer.'
just kidding, they just send it back saying, we arent going to fix it, it appears its been tampered with, blahblahblah.

easiest way to do it without having to talk to anyone is login to your xbox account on the internet www.xbox.com and hit the support tab, register the console, request repair. otherwise call 1-800-4-my-xbox. and youll talk to some indian for about 20 minutes while he 'trouble shoots' the problems with you, then hell register it perhaps, and then just say you need a coffin for it, and they will mail it out. should take about 4-5 weeks total.

Try to look for another warranty seal on Ebay. I bought a warranty seal off there earlier this year and sent my modded xbox to MS. I even did the x-clamp fix on the console, but after it RROD again a week with the x clamp fix, I decided to try my luck and buy the seal from Ebay, put the original x clamps back in the console and sent it in. They sent me a refurbished one in two weeks. I paid like 25 bucks for the new seal.
