My friend told me that people can download PS2 games then burn it and that is a backup.

    Is this true?

Because I wish to buy a Swap Magic to play my "i own my games, they are my own backups" and am slightly concerned that something would go wrong?

Yes you can download ps2 games and burn it as a backup. But you are better off making a backup of the games you own because downloaded games tend to have things wrong with them. Of course you will still need swap magic or some other type of mod to boot them.

Anything that works with backups of your own games will work with burned games you downloaded. It is illegal, though.
