I would like to buy a PS3 now. Just researching:

    http://en.wikipedia.org/wiki/PlayStation_3

According to the product list, the safest bet to buy (that are still available first-hand) are 120 or 250 GB slims since they'll definitely have firmware under 3.41. Is this true?

You will be very lucky to get a new console with fw 3.55 or below on it.

If you like in a nice country with good consumer rights then you can buy a console and if it isnt below 3.55 then return it saying you do not agree with the EULA, if the retailer says you should have checked that before you bought it, then say you couldnt cos its in the bloody box, so you cant read until you buy it anyway.

    A) Sony discontinued 120gb somewhere within the summer of 2009

    B) 3.56 firmware was released on January 2011

Possibility of a 120gb PS3 running >3.56 is therefore highly unlikely, if not utterly impossible.

Plus, I just got a 250gb bundled with Killzone 2 and Infamous. It came with 3.01

In fact I'm starting to think a 160gb model with "Package 2010 Copyright Sony" on the back of the box is a pretty safe bet too
