Has anyone ever gotten in trouble for downloading files from a free Wi-Fi hot spot, such as a hotel? Is this pretty safe? Can the hotel get in trouble for it? How come places that host free wi-fi, like Starbucks, don't get subpoened for things like this?

It depends on what you are downloading. If you are downloading something completely legal, there should be no problem. If you are a pirate, downloading something illegal from a torrent, there will most likely be problems.

What I'm asking tho is, if something illegal is downloaded from Starbucks or a library, wouldn't they be help liable. How come you never hear of this. So many places offer free wi-fi now, how do they protect themselves? Is there a way to track the person at all who used this free access? Maybe by MAC address or something?

    The firewalls probably prevent this.
