My son has been running his dslite with a m3ds real in it and now it has a hard time seeing the card. The DS is still under warrenty would there be any problem with me sending the DS back to have it looked at. Sometimes when the game is turned on it does not see the game in it I tried putting a piece of tape on the back of the card all this did was make the card hard to get in and out. Any advise or should I just send it back to nintendo? Would they be able to know that he was running a different card in the unit?

They wont be able to tell you were running a flashcart, though it is more likely that the problem is with the cart not properly fitting against the contact points than a problem with the DS. You should test it with an official cart and see if it still has problems.
