I tried to burn one of the infamous EMI copy-protected cds from a few years back and Nero did it all 100 %
what is causing this because it should obviously fail?

I have the following software installed but not open (perhaps one of these is destroying the copy protection)

    CloneCd
    Any Dvd
    DvdFab
    CopyToDvd

the EMI protection should prevent me from even converting the tracks to mp3 so whats happening?

I do realise they've since abandoned this method.
    any ideas or theories?

If you have AnyDVD running in the background it would take the protection off of the CD.

AnyDvd would be on the desktop as software but not officially open (as an icon on the system tray)
I'm using nero 9 they didn't overcome the copy-protection for cds?
anyway, I am leaning toward AnyDvd like you said.
    cheers for the ideas
