Yes, it has the 1031 firmware upgrade, I even tried the Samsung SH-W08A [same interals as the Toshiba 5272] upgrade with the same results. The firmware is back to 1031 now... Had the same problem with Verbatim's 2X to 16X DVD+R disks. Supposedly these disks would work on any burner from 2 to 16 speed according to Verbatim. Verbatim later told me that these disks have a different dye than their other disks and that I should purchace a burner that supports their dye. Sort of like buying a new car just to use new tires...
After all the rude attacks on Memorex, it appears that it does come down to firmware. Toshiba is poor on firmware support, and their drives generally do not support CMC or even Ritek coded discs (that also means HP, Philips, Memorex, Imation, TDK, Maxell, and other lesser known brands.) In the case of the original thread regarding the Toshiba drive, the cause is lack of firmware support. Nothing else.
