If you softmod your xbox you can put games on your hard drive, however you will not be able to go on live with the games on the modded xbox's hard drive.

If you go on live with a modded console you will be banned, you may not even be able to sign in.

When you first go onto live your eeprom and hard drive serial are "married" and if you ever go on live with a different hard drive your banned. Also when you go on live your xbox is scanned for the presence of files that don't belong on a normal stock xbox. If files which are present if you mod your xbox are found you will be banned. However, if you use a mod chip you can switch it on or off.
