I haven't used nero to encode, but this may be due to having a VBR (variable bit rate) mp3 sound stream. I'm assuming you're trying to encode an avi to dvd? if so you can use VirtualDubMod to extract the audio stream as a .wav file and then re-encode the .wav file to .mp2 or .ac3 if you're making it into a dvd file. If you are trying to convert avi to dvd, this problem has been posted multiple times, so try searching under VBR and sync problems.

this is most likely due to the fact that VDM does not have an audio codec to uncompress the stream. try using Gspot or avicodec to find out what type of audio you have in the avi file
